Employers, workers and their representatives are involved in the process of negotiating a proposed enterprise agreement. The employer must notify its employees of the right to be represented by a negotiator when negotiating an enterprise agreement (with the exception of an agreement on green grasslands) and no later than 14 days after the deadline for notification of the agreement (usually the start of negotiations). Disclosure should be notified to any current worker who is covered by the enterprise agreement. The terms of an enterprise agreement, transitional instruments (assignment or convention) and modern rewards cannot exclude the NES, and those who do so will have no effect. Pro`s collective agreement guarantees a level playing field of contractual relationship and fair compensation. A bargaining representative is a person or organization that any party to the enterprise agreement can appoint to represent him during the negotiation process. The trade union movement saw in the AEAs an attempt to undermine the power of trade unions in the negotiation of wages and the terms of their members. The unions argued that the ordinary worker himself had little or no bargaining power to effectively negotiate an agreement with an employer, so that there is, of course, unequal bargaining power for the contract. For exceptional individuals in the workplace or in labour-shortage sectors, the labour movement argues that common law contracts are sufficient. They also believe that, while commercial law and common law provide for fairness and equality in negotiations, the AAEs were designed to reinforce the inequality between employers and workers in terms of pay and conditions. The ACTU`s policy has been to eliminate AWAs and establish collective agreements.  The labour and employment legislation adopted by the Finnish parliament is the basis of collective agreements. As minimum wages are not set by Finnish labour and employment legislation, workers` wages are based on collective agreements negotiated by trade unions.
An enterprise agreement will enter into force seven days after the Approval of the Fair Work Commission or at a later date in accordance with the agreement. From that date, an employee`s terms and conditions are deducted from the enterprise agreement.
